1. Scope

These Terms of Service ("Terms") govern the use of the BrandStyleKit web application ("Service") operated by [Company Name], [Street Address], [Postal Code] Salzburg, Austria ("we", "us", "our").

By creating an account or using our Service, you agree to these Terms. If you do not agree, please do not use our Service.

2. Service Description

BrandStyleKit is an AI-powered design token generator that:

• Generates production-ready design tokens (CSS Custom Properties, Tailwind Config, Figma JSON, Markdown Style Guide) based on user input.
• Provides a visual wizard for brand briefing (industry, colors, fonts, mood, archetypes, style DNA).
• Offers a Token Explorer for reviewing, refining, and exporting generated tokens.

The AI-generated output is created using third-party language models (Anthropic Claude, Google Gemini) and deterministic algorithms. Results may vary and are provided as-is.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete registration information.
• Keep your login credentials confidential.
• Be responsible for all activities that occur under your account.
• Notify us immediately of any unauthorized use of your account.

Guest access is available with limited functionality. Full features require a registered account and a valid plan.

4. Credits & Payment Terms

4.1 Credit System

BrandStyleKit uses a credit-based system. Each brand kit generation consumes one credit. Credits are included in your purchased plan and cannot be transferred to other accounts.

4.2 Plans & Pricing

We offer one-time purchase plans and subscription plans. Current pricing is displayed on our Pricing page. All prices are in Euros (EUR) and include applicable taxes.

4.3 Payment Processing

All payments are processed securely through Stripe. We do not store your full payment card details. By making a purchase, you also agree to Stripe's Terms of Service.

4.4 Subscriptions

Subscription plans renew automatically at the end of each billing period (monthly or yearly). You can cancel your subscription at any time through your account settings or the Stripe Customer Portal. Cancellation takes effect at the end of the current billing period.

4.5 Refunds

One-time purchases and consumed credits are non-refundable. For subscription plans, the statutory right of withdrawal under Austrian and EU consumer law applies. If you are a consumer within the EU, you have the right to withdraw from the contract within 14 days of subscription without giving any reason, provided no credits have been consumed.

5. Intellectual Property & Generated Content

5.1 Your Generated Tokens

You retain full usage rights to all design tokens generated through the Service. You may use the exported tokens in any personal or commercial project without restriction. We do not claim ownership over your generated output.

5.2 Our Intellectual Property

The Service itself — including its design, code, algorithms, branding, and documentation — remains our intellectual property. You may not copy, modify, distribute, or create derivative works of the Service without our prior written consent.

5.3 No Guarantee of Uniqueness

Generated design tokens are based on AI models and deterministic algorithms. We do not guarantee that the generated output is unique or that it does not resemble tokens generated for other users.

6. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any applicable law.
• Attempt to reverse-engineer, decompile, or extract the source code of the Service.
• Use automated tools (bots, scrapers) to access the Service without our prior written consent.
• Resell or redistribute the Service itself (as opposed to the generated tokens, which you may freely use).
• Circumvent any security or access control mechanisms of the Service.

7. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by Austrian law:

• We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service.
• Our total liability is limited to the amount you have paid for the Service in the 12 months preceding the claim.
• We do not guarantee uninterrupted or error-free operation of the Service.

These limitations do not affect your statutory rights as a consumer under Austrian and EU law.

8. Service Availability

We strive to keep the Service available at all times but do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, updates, or technical reasons. We will endeavor to provide advance notice of planned maintenance.

9. Termination

You may terminate your account at any time by contacting us at [email@example.com]. We may terminate or suspend your account if you violate these Terms.

Upon termination, your right to use the Service ceases immediately. Your generated brand kits may be deleted after a reasonable retention period. Previously exported tokens remain yours.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the website. Continued use of the Service after changes constitutes acceptance of the modified Terms.

11. Governing Law & Jurisdiction

These Terms are governed by the laws of the Republic of Austria, excluding its conflict of law provisions. The place of jurisdiction is Salzburg, Austria. For consumers within the EU, mandatory consumer protection provisions of your country of residence apply.

12. Severability Clause

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced with a valid provision that comes closest to the economic purpose of the original provision.
